The delivery of an order placed by the User through the Website may either be undertaken directly by the TP Service Provider or facilitated by the Company personnel or through a third-party who may be available to provide delivery services to the User (“Delivery Partners”). In the above mentioned events, the Company is merely acting as an intermediary between the User and the Delivery Partners, or the User and the TP Service Provider, as the case may be.
The User agrees to respect the Delivery Partners and will not discriminate against any Delivery Partner on the basis of race, community, religion, disability, gender, sexual orientation, gender identity, age or any other legally protected status.
The Company will charge a delivery fee for delivering the order of the User (“Delivery Fee”). The Delivery Fee may vary depending on multiple factors including but not limited to the order value, distance and time. The Company will inform the User about the Delivery Fee at the time of placing the order on the Website and the User will be responsible for the payment of such Delivery Fee regardless of his awareness of such Delivery Fee.
The acceptance by a Delivery Partner of undertaking delivery of the User’s order shall constitute a contract of service under the Consumer Protection Act, 2019 or any successor legislations, between the User and the Delivery Partner, to which the Company is not a party under any applicable law.
In the event the Company is facilitating delivery of an order placed by the User, the Company shall not be liable for any acts or omissions on part of the Delivery Partner including deficiency in service, wrong delivery of order, time taken to deliver the order, order package tampering, etc.
PART B –DELIVERY SERVICES
The User may place an order on the Website to deliver any documents or goods (“Delivery Goods”) to any location within the geographical boundaries of Mumbaiand Thane. The placing of delivery order shall be subject to availability and confirmation of the order by the Delivery Partner.
The User shall ensure that the documents or goods to be delivered shall be appropriately packed so that such documents or goods are fully protected from any damage in transit. The User shall bear the sole responsibility to any damage caused to the document or goods where the damage is not attributable to any act or omission of the Delivery Partner.
The Delivery Partner has the right to refuse the delivery of documents or goods for reasons including but not limited to insufficient packaging or no packing or if the goods are larger, heavier or do not match the description provided by the User.
The Company shall provide the prices for the delivery of the documents or goods at the time booking the order on the Website. The prices for the use of delivery services through the Website by the User shall depend on the factors including but not limited to the time, distance, availability, weight and value of the documents or goods to be delivered.
In addition to pick-up and delivery of the documents or goods, the Company shall also provide a tracking code, pick up time and expected delivery time to the User through the Website.
The User agrees that once the order has been booked by him on the Website, the order cannot be cancelled. In the event, the User wishes to cancel the order after booking it, the User will be charged the entire booking amount as specified on the Website. The User shall have the right to change the address of the pick-up location or delivery location of the documents or goods, however such change of address of pick-up location or delivery location will be subject to change in booking price.
The Users can insure their documents or goods that are to be delivered by the Delivery Partners by paying an amount based on the order value decided by the Company, to protect their documents or goods from being damaged during transit. The said insurance charges will be charged to the User over and above the Delivery Fees.
